We all know that the tag has to be readable but in the northern states anytime now we are going to get snow. That means that our tags are going to be constantly covered either in snow or the slush that the salt causes. I ask, is it reasonable to expect folks to stop every mile or so to clean their tags. If they dont, then they are in constant violation of the law. But would you not think that an officer that lives where we do would know all this and if they do have occasion to stop you, given the conditions of the day, they would just ask you to clean it off. Every winter we get several cases through the office where an over “zealous”, you can read that as “brainless” cop has handed out a ticket for a obscured tag plate. We usually beat them but it costs our clients money to do so, but what is far worse, it costs the police department the lack of goodwill from the community and the loss of credibility.Once on our way to court, a client and me took pictures of a police car parked in Coolidge Corner with a dirty plate, showed it to the judge and she threw the case out. As I remember, the judge said she hopes I will not be checking her plate, the inference being that in winter in the north it is impossible to have clean tag plates. |
